Auction Terms and Conditions
General terms

These general terms apply to auctions conducted by Ayaphumuza Auctioneers (“Ayaphumuza”, “we”, “us” or “our”). The catalogue, auction notice and any special conditions published for a particular auction form part of that auction’s terms. If they differ from these general terms, the auction-specific terms apply.
1. Registration and bidding
Only a registered and approved bidder may bid. You must provide accurate information, keep your account secure and use your own account. We may require identity or other verification before allowing participation. We may refuse or suspend registration where permitted by law or the auction-specific terms.
By submitting a bid, you confirm that you have authority to make the purchase and agree to be bound by the bid if it is accepted. Online bids are recorded by the BidJS platform. The platform’s recorded time and bid history will be used to administer the auction, subject to correction of an obvious technical error.
2. Goods and inspection
Goods are offered as described in the applicable catalogue and sale notice. You are responsible for inspecting goods, reviewing photographs and descriptions, checking dimensions and condition, and satisfying yourself about suitability before bidding. Viewing arrangements will be stated for each auction. Unless expressly stated otherwise, goods are sold in their present condition and with the defects disclosed or reasonably discoverable on inspection, subject always to rights that cannot lawfully be excluded.
3. Reserves and auction control
Each lot is subject to the reserve, withdrawal, bidding increments and other conditions disclosed for that auction. A bid does not guarantee that a lot will sell unless the auction-specific terms state that it is without reserve. Ayaphumuza may correct an obvious error, pause or close bidding, withdraw a lot where authorised, or reject a bid where permitted by law and the applicable terms.
4. Price, fees and taxes
The successful bid amount is not necessarily the total amount payable. The buyer’s premium, VAT or other charges, if applicable, will be stated in the auction notice or catalogue. You are responsible for checking those amounts before bidding. No payment is made through this website. Any payment reference issued by AuctionOps is an identifier for future EFT instructions only; use payment instructions supplied through the authenticated bidder workflow.
5. Payment, collection and risk
The winning bidder must pay by the deadline and in the manner stated in the auction-specific terms. We may require a deposit or proof of payment. Ownership, risk and release of the goods are subject to applicable law, cleared payment and the auction-specific terms. The buyer must collect the goods during the published collection period and at the stated location, at the buyer’s cost, unless agreed otherwise in writing. Storage, removal or other costs caused by late collection may be charged where disclosed or legally permitted.
6. Default
If a buyer fails to pay or collect, Ayaphumuza or the seller may exercise the remedies available under the auction-specific terms and applicable law. These may include cancelling the sale, retaining an agreed deposit, charging reasonable costs, or offering the lot for resale. Any remedy will be applied subject to the Consumer Protection Act and other applicable law.
7. Personal information and communications
Personal information is processed in accordance with our Privacy and POPIA notice. We may contact registered bidders about an auction, account, payment or collection matter. We do not accept identity documents or other private bidder documents by ordinary email; use My Documents when instructed.
8. Questions and complaints
Ask questions about a lot, fees, viewing or collection before bidding by contacting info@ayaphumuza.co.za. Nothing in these terms limits a consumer right or remedy that cannot lawfully be limited. These terms are intended to be read with the Consumer Protection Act 68 of 2008 and its auction regulations.
